These Terms of Service (“Terms”) govern your use of www.bonocarbono.com and any purchase from Bono Carbono (“Bono Carbono,” “we,” “us,” or “our”). By accessing our site or purchasing a product, you agree to these Terms. If you do not agree, do not use the site.
1. Online Store and Eligibility
You must be old enough to enter into a binding contract in your jurisdiction to use this store. You may not use our products or services for an unlawful purpose or violate applicable laws.
2. Products and Availability
Bono Carbono sells handmade ceramic mugs and original-design apparel. Handmade products may have minor variations in color, finish, placement, or appearance that are part of their handmade character. Apparel and other products may be produced on demand through Printful or another fulfillment partner after an order is placed.
Product images and colors are displayed as accurately as reasonably possible, but screens and handmade production can create differences. Products, designs, prices, and availability may change without notice. We may limit quantities or discontinue products.
3. Orders and Acceptance
Your order is an offer to purchase. We may accept, decline, limit, or cancel an order for reasons including suspected fraud, pricing or inventory errors, product unavailability, delivery limitations, or violation of these Terms. If we cancel an order after payment, we will refund the amount charged for the canceled portion.
You are responsible for providing accurate billing, shipping, contact, and payment information. Contact support@bonocarbono.com immediately about a requested change. Changes or cancellations are not guaranteed after production or fulfillment begins.
4. Prices, Payments, and Taxes
Prices are shown in the currency selected on the store and may change without notice. Applicable taxes, shipping charges, duties, and other fees are shown when available during checkout. You authorize us and our payment providers to charge your selected payment method for the total displayed at checkout.
We may correct pricing, description, or calculation errors and cancel affected orders, including after submission, subject to applicable law.
5. Shipping and Delivery
Delivery estimates are not guarantees. Production times, carrier delays, weather, customs, incorrect addresses, and other events outside our control may affect delivery. Risk of loss and title pass as provided by applicable law and the carrier terms.
You are responsible for entering a complete and accurate delivery address. Additional costs may apply when an order must be reshipped because of an incorrect address or an unclaimed package.
6. Returns, Refunds, and Cancellations
Returns, refunds, exchanges, damage claims, and cancellations are governed by our Refund Policy, which is incorporated into these Terms. Because some apparel is produced on demand, buyer’s-remorse returns and size or color exchanges may not be available except where required by law.
7. Intellectual Property
The site and its content—including Bono Carbono names, logos, artwork, graphics, product designs, photographs, text, and layout—are owned by or licensed to Bono Carbono and protected by intellectual property laws. You may use the site only for personal, non-commercial shopping purposes.
You may not copy, reproduce, modify, distribute, sell, license, scrape, publish, create derivative works from, or commercially exploit our content or designs without prior written permission.
8. Reviews and User Content
If you submit a review, image, suggestion, or other content, you represent that you have the right to submit it and that it is lawful and accurate. You grant Bono Carbono a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and display that content for operating and promoting the business. We may remove content that violates these Terms or the rights of others.
9. Third-Party Services and Links
Our store is hosted by Shopify and may use third parties such as payment processors, Printful, shipping carriers, analytics providers, and advertising services. Third-party services and websites are governed by their own terms and policies. We are not responsible for third-party content or services except as required by law.
10. Privacy
Our collection and use of personal information are described in our Privacy Policy. Shopify and other service providers may process information as described there.
11. Prohibited Uses
You may not use the site to violate law; infringe intellectual property or privacy rights; submit harmful, deceptive, abusive, or malicious content; transmit malware; interfere with security or operation; scrape or collect information without authorization; impersonate another person; or attempt unauthorized access to systems or accounts.
12. Disclaimer of Warranties
To the fullest extent permitted by law, the site and services are provided “as is” and “as available.” We do not guarantee uninterrupted or error-free access. Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.
13. Limitation of Liability
To the fullest extent permitted by law, Bono Carbono and its owners, employees, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits or data, arising from use of the site or products. Where liability cannot be excluded, our aggregate liability will not exceed the amount you paid for the product or order giving rise to the claim.
These limitations do not apply where prohibited by law or to liability that cannot legally be limited.
14. Indemnification
To the extent permitted by law, you agree to indemnify and hold Bono Carbono harmless from third-party claims, losses, or expenses arising from your unlawful misuse of the site, your violation of these Terms, or your infringement of another person’s rights.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of New Jersey and applicable federal law, without regard to conflict-of-law principles. Subject to mandatory consumer protections, disputes will be brought in the state or federal courts located in New Jersey, and the parties consent to their jurisdiction.
If you are a consumer, you retain any mandatory rights and remedies available under the laws of your place of residence.
16. Changes to These Terms
We may update these Terms by posting a revised version on this page. Changes apply from the stated “Last updated” date. Your continued use of the site after an update constitutes acceptance to the extent permitted by law.
17. Severability and Entire Agreement
If a provision is found unenforceable, the remaining provisions remain in effect. These Terms and the policies linked here constitute the agreement between you and Bono Carbono concerning use of the store and supersede prior versions.
